Privacy policy

This Privacy Policy (the “Policy”) describes the User data that the Company may collect and use in the App. All terms used in this Policy are defined in the Terms of Use of the Mobile App (the “Terms”).

For the purposes of this Policy, “personal data” means information that can identify an individual. “Information” refers to other data provided by the User or information about the User’s activity (such as use of the App) that does not identify the User.

General provisions

1.1. This Policy sets out the purposes and procedures for collecting, using, transferring and protecting information that the Company collects when the User uses the App.

1.2. The Company respects and protects users’ right to privacy and undertakes to take all necessary measures to do so.

1.3. By using the App, the User agrees to this Policy. By registering and using an Account in the App, the User consents to the collection, use and disclosure of their personal data and other information they provide, in accordance with this Policy and the applicable laws of Ukraine.

Personal data

2.1. When using the App, the User voluntarily provides personal data to the extent specified in the relevant form in the App and in the Terms.

2.2. The User understands that they must provide accurate personal data and information for the App to function correctly and for them to participate in the Bonus Programme. The User is solely responsible for the accuracy and correctness of the data they provide when using the App.

2.3. Minors may use the App. Its content is suitable for all age groups, taking into account the ability to carry out payment transactions.

Collection and use of information

3.1. When registering in the App, the User must provide their name, sex, mobile phone number, date of birth and their own email address.

3.2. To ensure that the App functions correctly, the Company may also collect the following information:

• Information about the User’s mobile device: model, operating system version and unique identifiers.
• Geolocation data from the User’s mobile device, if the User grants permission in the App, to use geofencing and the User’s location to display the distance to the restaurant and determine the shortest route.
• Log data about the use of the App or information viewed through it, including search queries, IP addresses, hardware events (including crashes and system activity), settings, and the date and time of specific actions taken by the User in the App.

Information about children under 14 is collected under the same procedure and to the same extent.

All the data and information listed above will be used solely to ensure that the App functions correctly.

The Company retains users’ personal data and other information for the period necessary to conduct its business activities and until the User requests deletion of that information.

Storage of information

4.1. The Company acts as the custodian of the information and undertakes not to disclose or transfer the personal data and other information it collects about the User to third parties, except as provided in this Policy.

4.2. The Company does not sell, rent, share or otherwise transfer users’ personal information to third parties.

4.3. The Company may disclose personal data where doing so is justified and reasonable, specifically where disclosure:

4.3.1. Is necessary to comply with the applicable laws of Ukraine;

4.3.2. Is necessary in criminal proceedings and/or court proceedings;

4.3.3. Follows from lawful requests made by public authorities;

4.3.4. Is necessary to protect the rights, property or safety of the Company, its Users, employees or the public, including, but not limited to, cases of fraud or unlawful use of the App.

4.4. The Company discloses information about the User to the extent necessary to fulfil the purposes that gave rise to the disclosure under clause 4.3 of this Policy.

Information security

5.1. The Company takes measures to protect users’ personal information and personal data against loss, misuse, unauthorised access, disclosure, alteration or destruction. No method of data transmission is completely secure. Despite the security measures it takes, the Company cannot guarantee the absolute security of information and data.

5.2. The Company is not liable for unlawful acts by third parties, hackers, malicious actors or other offenders who may attempt to obtain all or part of users’ information and personal data and use it for their own purposes.

5.3. The Company is not liable for any acts or omissions by Users or third parties in relation to the User’s personal data, whether obtained through use of the App or otherwise, if the User and/or third party gained access to that data through no fault of the Company.

Links to other websites

6.1. The App may contain links to third-party websites. The Company is not responsible for the content or operation of those websites or for any harm that may result from Users visiting them.

6.2. This Policy does not govern the provision of personal information when visiting third-party websites. The collection and transfer of personal information and personal data by Users are governed by the documents on the use of such information published on those websites.

Final provisions

7.1. The Company may unilaterally amend or update this Policy.

7.2. Any amendments or additions to this Policy take effect when published in the relevant section of the App or at https://eatery.club/privacy-policy.

7.3. By continuing to use the App after changes to this Policy, the User agrees to those changes.
